However Juan Alberto Vazquez, the freelance journalist who filmed the incident, maintained that Neely didn’t bodily assault any commuters.

Penny’s attorneys maintained that their shopper intervened to guard practice passengers.

Penny is due again to courtroom in July and faces a most of 15 years in jail if convicted.
